Discipline and Adverse Actions Update

The agency decided to implement a revision of the Departmental Manual for discipline and adverse actions 370DM752. The Union was given the opportunity to negotiate over this but found no reason to, as it was a significant improvement from the previous version. Therefore, the new policy has been implemented. The most important issue that everyone should be aware of is a 7 day time frame to appeal suspensions of 14 days or less, and 14 day time frame to appeal suspensions of 14 days or more and removals.

Another change is that the table of penalties has been clarified and significantly improved. Personnel bulletin 03-7 offers a well written discussion of how discipline for misconduct is to be determined and gives guidance for consideration of the Douglas Factors in determining the appropriate level of discipline. Union officials strongly suggest that bargaining unit (BU) members should review these documents to gain an understanding of the discipline process. Stewards and other Union officials should review these documents in detail in order to effectively represent BU employees in these matters.
